Can employers use E-Verify to Check Workers’ Immigration Status?
Employers are required to check immigration papers soon after it hires workers. Your employer
probably checked your immigration papers when you were hired. You probably showed your employer your documents and filled out an I-9 form.
Unless something changed, your employer should not check your documents again. E-Verify is a special way of checking documents that only some employers can use. The most important thing for you to know about E-Verify is that most employers can only check new employees in E-Verify.
That is what official U.S. Government posters say about E-Verify:
- “E-Verify should generally only be used at the time of hire.”
- “Employers can’t . . . use E-Verify for reverification.”
